TERMS & CONDITIONS FOR ALL PARTICIPANTS

IKEA SOFT TOY DRAWING COMPETITION 2020

Entry Requirements
SIA "Paul Mason Properties"  with corporate identity number 50103951541 and registered office at Bikeru st. 2, Dreilini, Stopiņu district, Latvia (“IKEA”); and
IKEA of Sweden AB with corporate identity number 556074-7551 and registered office at Tulpanvägen 8, 343 34 Älmhult, Sweden (“IoS”),
are in collaboration organizing the IKEA Soft Toy Drawing Competition.
1.    The IKEA Soft Toy Drawing Competition will take place online  in Lithuania between the following dates: 10.11.2020  and 03.12.2020  (Submission period: from 10.11.2020 till 23.11.2020; Voting period: from 24.11.2020 till 01.12.2020; Country level finalists announcement: 03.12.2020). This competition is open to children with parents and guardians who are IKEA Family Members (“IKEA Family Members”). Children may not be older than 12 years old to participate. IKEA employees and their immediate families are excluded from the competition. 
2.    IKEA reserves the right at any time to require any IKEA Family member that enters the competition to provide proof of eligibility to enter the competition. If the participant is required to provide such evidence and fails to do so IKEA at its sole discretion may disqualify the participant from the competition.
3.    No purchase or any other fee payment is necessary in order to participate in the competition. 
4.    All those intending to participate in the competition must have the consent of their parent or guardian to do so. Consent is presumed if the parent or guardian has filled the submission form online at www.ikea.lv/lv/digital-drawing-competition and accepted these Terms and Conditions for All Participants. The parent or guardian will also have to prove his/her membership in IKEA Family by filling IKEA Family card number in submission form to be able to participate in the competition. Parental supervision is also required during the participation of the competition. 
5.    Only one entry can be made by each individual child. A child participant cannot be assisted in his/her participation by parent, guardian or any third party. Any such entries will be disqualified. Late or incomplete entries will also be disqualified. 
6.    Each participant’s drawing must be completed on A4 or letter sized white paper. Each participant and his/her parent or guardian must indicate in the submission form the following information:
i.    First name and age of the participant; 
ii.    Contact information and the IKEA Family membership number of the parent or guardian.

How to participate
7.    IKEA will invite all participants to enter the competition online at www.ikea.lv/lv/digital-drawing-competition. Participants will be asked to make a drawing of their dream soft toy.
8.    A list of all  drawings  will be published at www.IKEA.lt. Before publishing drawings at the website they are checked and approved by IKEA, if they meet the requirements of Terms and Conditions for All Participants. The approval will take one working day from the submission of the drawing. 
9.    A short list of 15 drawings (“Country Level Finalists”) will be put forward by online voting and by jury established by the IKEA. 8 Country Level finalists will be selected by online voting, and 7 drawing by IKEA jury.
10.    The 15 Country Level Finalists from each participating country will be sent to IoS where a judging panel will select 6 winning international drawings (“Global Level Winners”). The judging panel consists of the soft toys product development team at IoS. 
11.    Criteria for electing the Global Level Winners are based on news value, uniqueness, commercial potential and possibility to manufacture as soft toys.

Prizes
12.    All entries will receive a diploma and a small present. Small present will be sent by email. All 15 Country level finalists will receive 30 Eur IKEA gift card.
13.    The Global Level Winners will receive one soft toy each created by IoS based on the Global Level Winners’ drawings. There will be 6 Global Level Winners in total. Not all Country Level Finalists or Store Level Finalists will become Global Level Winners and therefore will not receive a soft toy from their own drawings. 
14.    All prizes are non-negotiable, non-transferable and non-refundable. No cash or credit alternatives will be given in exchange for the whole or any part of the prizes. IKEA reserves the right to substitute the prize with another prize or equivalent value. Any eventual tax debt that arises out of or in connection to the prize received shall be paid by the parent or guardian for the Global Level Winner in accordance with local legislation.
15.    IKEA and/or IoS reserve the absolute right to select an alternate winner and award the prize to another participant in the event that IKEA and/or IoS have reasonable grounds to believe that a participant has acted in a way which is inconsistent and contrary with these Terms and Conditions for All Participants or has acted in a way which IKEA and/or IoS consider to be inappropriate, unlawful or offensive. 
16.    The Country Level Finalists and Global Level Winners will be notified by e-mail by IKEA.
17.    IoS will select the 6 Global Level Winners. This decision is final. No correspondence on any matter concerning the election of the Global Level Winners will be entered into with any IKEA Family member.

Liability and permissions

19.    IKEA and/or IoS do not accept responsibility for network, computer or software failures of any kind which may restrict or delay the sending or receipt of your e-mail. Proof of sending is not a proof of an e-mail receipt. 
20.    IKEA and/or IoS are not be liable for any loss arising from the postponement, cancellation, delay or change to the prize beyond its control or for any act or default of any third party supplier. IKEA and/or IoS do not exclude or limit liability in any way for death or personal injury arising out of our negligence or fraud or by unforeseen circumstances.

Personal data
21.    In order to enter into this competition, participants and their parents or guardians will be required to provide certain personal data. The parent or guardian acknowledges to have read and understood the content of the Privacy Statement, in which it is described how the personal data is intended to be processed. 
22.    The parent or guardian is aware of that the child’s first name, age and country, if selected Global Level Winner, will be published globally online e.g. webpages and social media as well as in printed media. This means that the child’s first name, age and country will be transferred to countries outside the European Economic Area. Publishing online further means that IKEA will not be in complete control over the personal data as IKEA will not be able to prevent any individual from downloading and spreading the personal data.

Intellectual property rights
23.    IoS would like to base new product designs on the competition entries (drawings) from the 6 Global Level Winners and manufacture a limited product offer from these designs with the purpose to sell in all IKEA franchisee stores and IKEA franchisee online shopping (commercial use). For each sold soft toy from this limited product offer, IKEA will make a charitable donation, chosen by IKEA, that support children in need, children’s development or play. 
24.    All competition entries must be the original work of the participant. Any intellectual property rights including but not limited to copyright and design rights in the drawings and the description of the creative process provided by participants, in the winning entries, and in the toys made, are transferred to and shall belong to IoS from the point at which the competition entries are provided to IKEA. IoS has the right to alter and adapt the original work in order to create the soft toys. The original work and any alterations and adaptions may be used by any IoS affiliate in marketing material irrespective of medium and form.
25.    The participant will only be named by first name, if named at all, in connection with marketing. Any right to be named in connection with the sales and production of the soft toy is hereby waived.
26.    The 6 Global Level Winners whose drawings are purposed for commercial use will have no rights in the designs or receive any remuneration, reward or other benefit as a result of the use of their design other than the prizes provided for in these Terms & Conditions for All Participants. IKEA will not develop products based on any of the non-winners in the competition. If any of the 6 designs is not possible to manufacture or commercialise, IoS reserves the right to remove this product and exchange it.  

Governing Law
27.    The IKEA Soft Toy Drawing Competition and any dispute or claim arising out of or in connection with it, shall be governed and construed in accordance with laws of Latvia.

By entering the IKEA Soft Toy Drawing Competition, all participants and parents or guardians will be deemed to have accepted and agreed to be bound by the Terms & Conditions for All Participants. The parent or guardian acknowledges to have read and understood the content of the Privacy Statement.

Who are the many people? You are! Whether you’re an IKEA customer, co-worker or business partner, the IKEA vision is all about you. So naturally, we want to get to know you better.

One way we do that is by collecting your personal information. If you’re reading this, you’re probably curious what information we collect and how we use it. Read on to find out.

1. How we respect your privacy
Our approach at IKEA of Sweden AB and SIA "Paul Mason Properties" is to be as open and transparent as possible about how we collect and use your information. IKEA of Sweden AB and SIA "Paul Mason Properties" are jointly responsible (as joint controllers) for the processing of your information described hereunder – and SIA "Paul Mason Properties" has undertaken the overall responsibility to observe and fulfil the responsibilities imposed under the Articles 12-22 of the GDPR, i.e. informing and ensuring your rights relation to our the use of your data. 

First, we let you know exactly what information we collect and why. You can read all about that in the next section.

Second, we let you know what we do with your information. Who do we share it with? What do they do with it? You can read about that in section 3. 

Third, we protect your information and let you know how long we keep it. Read about that in sections 4 and 5.

Finally, we let you know your choices when it comes to your personal information, including who to contact if you have questions or requests. Read about that in sections 6 and 7.

2. What information we collect and why
We want to make your IKEA experience great! To do that we collect several types of information about you.

You provide us with your information. We need your information for administrative purposes in order to  perform the IKEA Soft Toy Drawing Competition. We also need your IKEA Family membership number to make sure that the child is entitled to participate in the IKEA Soft Toy Drawing Competition. IKEA processes your information on the legal basis of performance of contract.

We will also need your contact information as long as the IP rights apply. IKEA processes this information on the legal basis of our legitimate interest of being able to prove and protect our IP rights as laid down by the Terms and Conditions regarding the IKEA Soft Toy Drawing Competition.
Child:
•    First name 
•    Age
•    Country
You and/or your parent/guardian provide(s) us with your information. We need all of your information for marketing purposes by way of publication online e.g. webpages and social media as well as in printed media due to the participation in the IKEA Soft Toy Drawing Competition. We also need your age to make sure that you are entitled to participate in the IKEA Soft Toy Drawing Competition. IKEA processes your information on the legal basis of performance of contract.

We will also need your first name and age as long as the IP rights apply. IKEA processes this information on the legal basis of our legitimate interest of being able to prove and protect our IP rights as laid down by the Terms and Conditions regarding the IKEA Soft Toy Drawing Competition.

3. Who we share your information with
We do not sell or trade your information to third parties, but we share with others who can help us achieve the IKEA vision. That can be other IKEA companies, service providers or business partners. We’re all committed to keep your information safe and secure.
 
Type Description
•    Within IKEA IKEA is one brand but many companies. Each plays a special role to achieve the IKEA vision. We may share your information with other companies operating under the IKEA brand.
•    Service providers We may also share your information with authorised IKEA service providers. Usually these are companies that store information or provide IT services.
•    Business partners We often work together with other companies that can help us achieve the IKEA vision. These companies might for example help us learn more about how people live or how to improve the IKEA product Range. Other companies might help us with media and marketing.

4. How we keep your personal information safe
We protect your information from all kinds of threats: destruction, loss, alteration, unauthorized disclosure or access. We do this in a variety of ways depending on where we store and use it. 

We are a part of a global group of companies, and we have service providers and business partners in many parts of the world. In some cases, we might have to transfer your information to one of these companies located outside the European Economic Area. We do our best to keep your information safe in these cases but technology can make it challenging. 

For transfers of your data to countries outside the European Economic Area we rely on so-called adequacy decisions from the EU. This means that the EU believes a country’s own laws or agreements provide adequate protection for your personal data. 

Some countries don’t have an adequacy decision and then we often sign an EU Model Contract Clause with the recipient. These are legal texts provided by the EU government. 

As already mentioned, we intend to publish some of the information online e.g. webpages and social media as well as printed media. This means that the information is instantly accessible and transferred to countries all over the world. For this particular type transfers adequacy decisions will not be applicable everywhere, and we cannot have EU Model Contract Clauses in place with every receiving party. Instead we rely on the legal basis of performance of contract. 

5. How long we keep your personal data
We keep your personal information for as long as your information is relevant for use by IKEA in marketing purposes in relation to the IKEA Soft Toy Drawing Competition and/or for the purposes of administrate and perform the IKEA Soft Toy Drawing Competition. When the information has outlived its use, we will delete it. 

The information processed solely to administrate and perform the IKEA Soft Toy Drawing Competition will be deleted 2 years after the administration and performance of the IKEA Soft Toy Drawing Competition if no further administration or performance is planned. 

The information processed for marketing purposes (the child’s name, age and country) will be stored as long as the IP rights apply.

Due to legal requirements the child’s name, age and parent’s or guardian’s contact information will be stored as long as the IP rights apply.

We may store your information longer than stated above if it is necessary because of legal requirements.

6. Your privacy rights 
You have many rights regarding your personal information. Read more about them below. If you would like to exercise them or learn more, feel free to contact us! You can find contact detail at the end of this statement. Please note that some of the rights may not be applicable to your situation.

Right of access
•    You have the right to know what personal information we process and why. That’s why we inform you in advance about our processing activities via this statement. If you have any questions, or would you like to learn more about what information we process from you, you are always welcome to contact us and we will provide you with further information. 

Right to rectification 
•    If you believe we store wrong information about you, such as your e.g. name, you can ask us to correct this.  

Right to erasure / right to be forgotten
•    You have the right to tell us to permanently erase your personal information from our records. You can do this for example if you believe there’s no longer any need for us to keep it. Or, if you previously have given your consent, you can just decide to withdraw it.

Right to restrict the processing activities
•    You have the right to restrict our processing activities in certain situations. This means we will continue to store your information, but we’ll temporarily stop any other processing. Why would you want to do this? For example if you’ve asked us to fix incorrect information. In this situation you may want us to stop processing until the information is correct.

Right to data portability
•    In certain situations you have the right to ask us to send your personal information in digital form to you, so that you can forward it to someone else. 

Right to object
•    You have the right to object to the processing of your information, even when we have a legitimate legal reason to process it. You can do this when we process your information on the basis of our legitimate interest, and you believe that your personal interest outweighs ours. If you do not want us using your information for direct marketing purposes, including profiling, we will comply in any case.

Right to withdraw consent
•    If we process your personal information based on your consent, you have the right to withdraw your consent anytime. 

Right to lodge a complaint with a supervisory authority
•    If you aren’t satisfied with the way we treat your personal information, you have the right to lodge a complaint about us to the national supervisory authority.
